The SEC accused Ripple of raising more than $1.3 billion by selling XRP to investors, claiming it should be considered a security.
However, the court determined that the sales of programmatic XRP did not meet the criteria of investment contracts, as they lacked the economic reality of institutional sales, which would typically involve an expectation of profits derived from the efforts of others.
